1. Acceptance of Terms

By accessing or using https://www.guidemarkimmigration.ca, including any contact form, assessment form, booking tool, secure document upload tool, resource page, payment link, WhatsApp Business profile or catalogue link, or other website feature, you agree to these Terms of Use.

If you do not agree with these Terms of Use, do not use the website.

Guidemark Immigration Consulting Inc. (“Guidemark,” “we,” “us,” or “our”) may update these Terms of Use at any time by posting a revised version on the website. Your continued use of the website after changes are posted means you accept the updated Terms of Use.

2. About Guidemark

Guidemark Immigration Consulting Inc. provides Canadian immigration and citizenship related consulting services through Mahrukh Shah, MPH, BSc, RCIC-IRB (College ID R1033853), a Regulated Canadian Immigration Consultant authorized by the College of Immigration and Citizenship Consultants (“CICC”).

Guidemark is based in Mississauga, Ontario, Canada.

3. General Information Only

The information on this website is provided for general informational purposes only. It is not immigration advice, legal advice, a legal opinion, or a substitute for advice based on your specific circumstances.

Immigration and citizenship matters depend on the facts, applicable law, policy, procedures, deadlines, evidence, and discretion of government or tribunal decision-makers. You should not rely on website content as advice for your matter.

4. No Consultant-Client Relationship from Website Use

Using this website, submitting a form, uploading documents, booking an appointment, making a payment, sending an email, leaving a voicemail, calling, sending a WhatsApp message, sending an SMS, or communicating with Guidemark does not by itself create a consultant-client relationship, a representation relationship, or any obligation for Guidemark to act for you.

A limited initial consultation may proceed only after any required written consultation agreement has been completed.

Ongoing immigration and citizenship consulting services are provided only after Guidemark agrees to act and a written Service Agreement has been reviewed and signed by the required parties.

Until a written agreement is in place, you should not assume that Guidemark represents you, has accepted responsibility for your matter, or is monitoring any deadline.

5. Preliminary Assessment Forms

Assessment forms and inquiry forms are for preliminary screening only. They help Guidemark understand the general nature of your inquiry before a consultation or next step is considered.

Submitting an assessment form does not:

  • guarantee eligibility;
  • guarantee approval;
  • create a consultant-client relationship;
  • create representation;
  • guarantee that Guidemark will accept your matter;
  • stop or extend any deadline;
  • replace professional advice.

You are responsible for ensuring the information you provide is true, complete, and accurate to the best of your knowledge.

6. Secure Document Upload

The secure document upload portal is intended for documents requested by Guidemark or submitted as part of an inquiry, consultation, preliminary review, or active matter.

Uploading documents does not create a consultant-client relationship or representation relationship.

Do not upload highly sensitive documents unless Guidemark has requested them or instructed you to submit them through a secure process. You are responsible for ensuring that any document you submit is accurate and that you have authority to provide it.

7. Third-Party Platforms for Booking, Payment, Video Meetings, and Messaging

Guidemark may use third-party platforms to support website operations, online booking, video consultations, payments, messaging, secure document submission, and business communications. These may include Google services, Stripe payment tools, WhatsApp Business, mobile telephone services, website hosting providers, form tools, and other service providers.

Your use of these third-party platforms may be subject to the terms, privacy policies, security practices, and availability of those providers. Guidemark does not control those third-party platforms and is not responsible for their independent services, outages, security incidents, policy changes, account restrictions, or data processing practices.

If you choose to communicate by WhatsApp Business, SMS, telephone, email, or another platform, you are responsible for using a method appropriate for the sensitivity and urgency of the information being shared. Do not send highly sensitive documents by ordinary email, SMS, voicemail, or WhatsApp unless Guidemark has requested that method or instructed you that it is appropriate.

8. Payments and Booking Tools

If online booking or payment tools are available, their use does not guarantee that Guidemark will accept your matter, provide representation, or obtain any outcome.

Online payments may be processed by a third-party payment processor such as Stripe. Payment processors may collect and process information needed to complete the transaction, issue payment confirmations, support refunds or disputes, calculate applicable taxes where enabled, and assist with fraud prevention. Guidemark does not store full payment card numbers.

Consultation fees, service fees, government fees, third-party fees, refund policies, and service scope are governed by the applicable written agreement, invoice, payment terms, or service-specific terms provided by Guidemark.

Government filing fees, biometrics fees, language testing fees, educational credential assessment fees, translation fees, courier fees, medical exam fees, and other third-party charges are separate unless expressly stated in writing.

9. No Guarantee of Outcome

Guidemark does not guarantee the success of any application, expression of interest, immigration process, citizenship process, refugee claim, appeal, hearing, admissibility matter, work permit, study permit, visitor matter, permanent residence application, sponsorship, LMIA, employer matter, business immigration matter, or other proceeding.

All decisions are made by government departments, tribunals, officers, delegates, or other authorized decision-makers. Guidemark does not control decision-making, processing times, policy changes, or outcomes.

10. No Government Affiliation

Guidemark is a private immigration consultancy. Guidemark is not part of, affiliated with, endorsed by, or acting on behalf of the Government of Canada, Immigration, Refugees and Citizenship Canada (IRCC), the Immigration and Refugee Board of Canada (IRB), the Canada Border Services Agency (CBSA), Employment and Social Development Canada (ESDC), Service Canada, any provincial or territorial government, or any foreign government.

Use of Guidemark’s services does not provide special access, priority processing, preferential treatment, or guaranteed results.

11. Scope of Services and Provincial Limitations

Guidemark provides services within the authorized scope of practice of an RCIC-IRB and within the competence, capacity, and regulatory obligations of the consultant.

Guidemark may provide Canadian immigration and citizenship consulting services, including services related to IRCC applications, federal immigration matters, citizenship matters, refugee and humanitarian matters, admissibility issues, IRB representation, business and employer immigration matters, and related procedures, where permitted by law and confirmed in a written agreement.

Guidemark does not provide legal services outside the authorized scope of Canadian immigration and citizenship consulting. Guidemark does not provide criminal law, family law, employment law, corporate law, tax law, real estate law, securities law, or Quebec civil law advice.

Guidemark does not provide provincial immigration consulting services in Quebec or Saskatchewan, or recruitment services requiring provincial authorization in Saskatchewan, unless Guidemark first confirms in writing that the required provincial authorization applies to the specific matter.

12. Employer, Business, and Recruitment-Related Matters

Guidemark may assist employers, HR representatives, business owners, entrepreneurs, and organizations with immigration-related matters such as LMIA, LMIA-exempt work permits, Employer Portal support, compliance review, and business immigration matters, where within scope and confirmed in a written agreement.

Guidemark does not guarantee that an employer will receive approval, that a worker will receive a permit, that a business immigration application will be approved, or that any person will obtain employment, admission, status, permanent residence, or citizenship.

Unless expressly confirmed in a written agreement and permitted by applicable law, Guidemark does not provide job placement, employment recruitment, student recruitment, or recruitment-for-fee services.

13. User Responsibilities

When using the website, you agree to:

  • provide accurate, current, and complete information;
  • use the website only for lawful purposes;
  • submit only documents and information you are authorized to provide;
  • avoid uploading malware, harmful files, false documents, or misleading information;
  • avoid impersonating another person;
  • avoid interfering with website security, operation, or availability;
  • avoid copying, scraping, reproducing, or exploiting website content for commercial purposes without written permission;
  • avoid using the website, WhatsApp Business, SMS, forms, or email to send spam, abusive communications, or unlawful material.

Guidemark may restrict, suspend, or block access to the website or related tools if misuse is suspected.

14. Prohibited Uses

You must not use the website or Guidemark communication channels to:

  • commit fraud;
  • submit false, forged, altered, misleading, or incomplete information;
  • attempt unauthorized access to any system, account, document, or file;
  • interfere with website security or performance;
  • upload viruses, malware, or harmful code;
  • harvest, scrape, or collect information from the website without authorization;
  • infringe intellectual property rights;
  • violate privacy rights;
  • harass, threaten, defame, or abuse any person;
  • breach any applicable law or regulation.

15. Communications Not Always Secure or Monitored

Guidemark takes reasonable steps to protect information submitted through the website and related tools. However, internet communications, ordinary email, telephone networks, SMS, voicemail, WhatsApp, and online transmissions may not be fully secure, immediate, or available at all times.

WhatsApp, SMS, voicemail, and social or messaging tools are not appropriate for emergencies, urgent removal matters, urgent hearing deadlines, or urgent status deadlines. If you have an urgent matter, seek professional assistance immediately and do not rely on a message being reviewed within a specific timeframe unless Guidemark has confirmed otherwise in writing.

16. Intellectual Property

All website content, including text, headings, layout, design, graphics, images, icons, forms, logos, branding, downloadable content, and other materials, is owned by or licensed to Guidemark Immigration Consulting Inc., unless otherwise stated.

You may view, download, or print website content for your own personal, non-commercial use, provided that you do not modify the content and do not remove any copyright, trademark, or proprietary notice.

You may not copy, reproduce, republish, distribute, transmit, sell, modify, mirror, scrape, frame, or commercially exploit any website content without Guidemark’s prior written permission.

“Guidemark Immigration Consulting” and the Guidemark logo are proprietary identifiers of Guidemark Immigration Consulting Inc. Unauthorized use is prohibited.

You authorize Guidemark to review, store, use, and disclose submitted information as reasonably necessary to respond to your inquiry, conduct preliminary screening, provide requested services, comply with professional obligations, and administer the website, subject to the Privacy Policy and applicable law.

18. Accuracy, Currency, and Availability of Website Content

Guidemark makes reasonable efforts to provide accurate and current website information. However, immigration laws, regulations, policies, forms, fees, procedures, processing times, program criteria, and tribunal practices may change without notice.

20. Testimonials

Testimonials, if displayed, reflect individual client experiences. They do not guarantee similar outcomes and should not be interpreted as a promise, prediction, or assurance of success in any other matter.

Immigration and citizenship outcomes depend on the facts of each case and the decision of the applicable government or tribunal decision-maker.

21. Privacy

Use of the website is also governed by the Guidemark Privacy Policy. By using the website or submitting information, you acknowledge that personal information will be handled in accordance with the Privacy Policy.

22. Disclaimer of Warranties

The website and its content are provided on an “as is” and “as available” basis.
